Battery issue a software issue?

Has there been any kind of consensus yet weather or not the battery issue is that of a software issue or a hardware issue? I have only had mine on the wall charger about 3 times now. Last night I charged it for well over 8 hours and this morning when I checked it I had the "plug" indicator but the battery was still not fully green. There was still a small slice that remained silver. Also the battery was not radioactively glowing as I see that some are.

The Apple store is about an hour away from me and I will be returning there tomorrow to return a case and purchase some screen protectors. I am wondering if I should exchange this phone for another unit or just wait and see what gets fixed in the coming updates? I am a little leary also of getting another unit as it could be more unstable than the one I have now. Which, compared to others, seems to be pretty solid.

I realize that this is Apple's first shot and it will take a little time to get the bugs worked out but for the price of this device I am a little put out by the simple problems that so many other companies don't have any trouble with. That doesn't mean however, that I don't think this device is totally amazing!

wait for the update that's coming this week.. it's gonna fix the battery meter not displaying correctly... I wouldn't risk exchanging it if you're getting good battery life
