The Apple store says it build in you can't turn it on or off
I heard it is not offered as of yet
I would like to find out what the deal is myself

OK let's look at this from where you live

In what markets is Wireless Emergency Alerts (WEA) or Commercial Mobile Alert System (CMAS) available?
AT&T has launched CMAS in these areas as of 1Q 2012:
  • New York City area (All 5 boroughs)
  • Washington, D.C.
  • Portland, Oregon
Additional markets will be added over time, as we continue growing and adding the technology in markets across the United States through 2012 and beyond.

This is AT&T
But still should the button not be there ?

I never had it. But I do have it with Weather Alert, available in the iTunes App store. Bennyboy likes this app too, I think. Well, he used to. lol
I do uses that too. My sons school offers the text service as well!
I get government alerts includig local alerts (I can pick and choose) and sons school alerts

The government will advise you when there is an alien invasion via an SMS message, allowing you to safely evacuate and survive.
And where exactly will I evacuate ( I like that word ) to? Can alien see me under water?

Edit: my stomach is full of gas lately, damn antibiotics. I need another plan.
