The "no restocking fee" is for those that want to return their phones not exchange them. Don't think your plan is going to work.

This is one reason that I don't think we'll see white until at least 30 days after iDay1. Probably closer to 45 days after iDay1 to eliminate the number of color changers? I was waiting for white but finally picked up a black last night and put a white bumper on it. It looks awesome and I now have no desire for an all white iPhone 4 :)

If you sell it on eBay, don't list as used if you can pass it off as new.

what if, for example, I wanted to exchange 16gb for 32gb, would that be allowed or would I have to sell mine on eBay?

Restocking Fees

Since Apple is waiving the restocking fees if an iPhone 4 customer returns his or her phone to an Apple store, what about iPhone 4 customers who return their phones to an AT&T store? Will the restocking fee also be waived for those customers? Does anyone have an answer to this?

If the phone is in new condition, then it's new. Semantics shouldn't cost someone hundreds.

Then state new condition. It's either new or it's not. It's not semantics.
