Trying to get a free battery replacement

My iPhone 3GS's battery is dying and I want to see if I can get a free replacement. I assume my chances are pretty limited since I'm out of warranty, but just wondering if the upcoming iPhone 5 presents an opportunity since the 3GS is going away anyway.

How can I maximize my chances... by going to the Apple Store right before the iPhone 5 is released, or right after? Any ideas?

Do not wait. If it's on warranty then you have nothing to worry about. I have seen people getting free replacements over "home button not being as it used to be". My own iPhone 4 was replaced because I had chip on it after I dropped it. In your case I wouldn't mention weak battery. Rather mention decrease in performance and frequent crashes. It helps if you bring it to them already upgraded to latest software and restored.
*just noticed you are out of warranty. Maybe it would be better to replace battery yourself
