Suckers born every minute. How do I know if I have an ATV2 or ATV3?
If you still have the box, the ATV3 will say 1080p on it. ATV2 will not have that on the box.
You can also go to the about screen on your ATV and if the screen resolution maxes out at 720p, it's an ATV2
You can't tell just by looking at the device itself.

Some people are willing to pay quite a bit for a device that can be jailbroken.

The Apple TV 3 says 1080p on the box. If you don't have the box you can check the model number.
ATV2: MC572LL/A, A1378
ATV3: MD199LL/A, A1427

At the risk of receiving yet another private message from mod with the subject line of Inappropriate Behavior, I will just say that in my opinion, mods get a little over eager on this forum sometimes.

As far as my original sucker line, I was just talking about people who would buy a $99 device at a 75% premium. While I've heard jail breaking of Apple TV casually mentioned a few times, I've never looked into it myself so didn't really know it was possible. But if I've got an ATV2 sitting at home that I can sell for 170 and then I can get a new one to do what I need for $99, I'm all over that. I cut the cable 3 years ago.

Bummer, chances are that model will not get a jailbreak, I believe it's a limitation with the hardware itself. I recently bought a Roku 3 box and have been very impressed with it. The only thing Roku lacks is the ability to Airplay from iPhone like an ATV can.

I think it's more a lack of demand. There are people who want an ATV jailbreak, but the numbers are far lower than they are for the iPhone so the jailbreak devs don't bother with it anymore and instead focus on iPhone/iPod/iPads. I used to jailbreak my ATVs, but I don't have a need for it anymore since we got AirPlay and live conversion of non-itunes friendly video formats. Of course there are other reasons to jailbreak them, but it's nothing I'm interested in.

That's true and the main reason but I remember reading (can't find the source at this time) something about the size of the memory available to load an exploit being a issue as well.
