OTA Update iOS 5

How come when my brothers iPod touch 4g, when has a iOS 5.1 update it has a badge (1) on the settings>general>software update but my iPhone 4S doesn't & I'm on 5.0.1 does anyone know why?

It all comes at different times...my moms came a day after the update..my teachers came 3 days after. But I really don't know.

You can still manually check for updates and 5.1 should show even without the badge.
